Analysis On Sector-specific Regulation And Anti-monopoly Regulation In Railway Industry

Railway industry is one of the most important sectors which play a very serious role in the whole national economics and social development. The anti-monopoly issues in railway industry have been paid more and more attention and the research on sector-specific regulation and anti-monopoly regulation has been becoming a new problem both in economics and laws areas. The author firstly begins with the analysis of natural monopoly character and industry specialty in railway industry, showing the development and movement of regulation in this area and analyzing the types of competition and the anti-competition behavior in this area. All of these are theoretical precondition for entering into the issues. Basic on the common analysis framework given above, the author then studies how to understand deal with the relation of the sector-specific regulation and anti-monopoly regulation comprehensively and gives suggestions for the regulation of China's railway industry. There are for chapters in this paper:Chapter 1 mainly investigates the regulation and the development of railway industry. First on the basis of analyzing the industry specialty, the natural monopoly character and regulation of railway industry are introduced. Second, the theoretical and practical bases of sector-specific regulation and no anti-monopoly regulation are pointed out. Third, the monopoly character of railway industry is changeable and competition can be introduced to this industry. These analyses are the basis of the following text.Chapter 2 chiefly demonstrates the deregulation and competition of railway industry. First, the theoretical, economic and practical bases are summarized and the sector-specific regulation institution is showed. Second, both inside competition and outside competition are brought into sight by means of chart model, and there are five competition models and one model about China's railway industry. Third, three anti-competition behaviors are analyzed and these are the precondition of anti-monopoly regulation in railway industry.Chapter 3 outlines the anti-monopoly regulation on railway industry. First, the anti-monopoly regulations about above anti-competition behaviors are discussed carefully. Second, China's anti-monopoly regulation on railway industry is provided including before and after anti-trust law. Third, anti-monopoly institution is simply analyzed.Chapter 4 particularly works over the relation of sector-specific regulation and anti-monopoly regulation on railway industry. First, general conflicts and vinculums of this two regulation method are introduced. Second, the premise and effort of harmony and partition of power are discussed. It indicates that the adjusting mechanism, such as regulator power division, cooperation and power standoff.Conclusion points out that not only the sector-specific regulation but the anti-monopoly regulation are important for the development of railway industry and we should give more efforts to study in-depth field.
