The railway, which is one of the most important transportation modes, has very important consequence in national economy. As a result of some special character of China's railway industry, it is always in the range of "application exception" of anti-monopoly law as a natural monopoly industry. In China, the regulation of the railway industry is mainly to protect and manage the railway industry, and to keep the monopoly state. A reason is the particular economy times and the other is lack of a integrated anti-monopoly law. As long as the improvement of market economy and the continually extending of the railway's management mode and scope, the monopoly state of railway has changed gradually. So the intrinsic jurisprudence is difficult to regulate. In such situation, "Anti-Monopoly Law of the People's Republic of China" is promulgated and carried into execution in future, which will be great to reverse the situation.In the existing problems related to the study of the railway industry monopoly regulation mainly concentrated in government regulation, which is researched and introduced much, but most of them are merely economic policies, administrative regulations and regulations level, there are few expositions of the railway monopoly of the industry from a legal point of view. China's anti-monopoly law as a major historic introduced, become a important legal basis of the railway industry monopoly legal regulation. In this paper, on the existing basis of reform and development of China's railway industry, the writer will research on the current monopoly state of China's railway industry, its legal regulation of the necessity and feasibility of the system, and several Western developed countries which have experiences of the legal monopoly of the railway industry Regulation, in order to improve China's railway industry monopoly Legal Regulation System.
