On Issues Concerning Crimes Committed By Mafia-style Criminal Gang

Crimes Committed by Mafia-style Criminal Gang do more harm to society than ordinary crimes, because its development and spreading severely threaten the political and economical safety of countries worldwide. In our country, with enforcement of the reform and opening-up policy, great changes has been taking place in all fields in China. During this process, some negative issues arise, which, together with some deficiencies in the political and economic system provides possibilities and recourses for the development of Crimes Committed by Mafia-style Criminal Gang. Recently, Crimes Committed by Mafia-style Criminal Gang act like a kind of dark force conflicting with lawful power of our authorities. The way of scientifically observation to Crimes Committed by Mafia-style Criminal Gang and reasonable analysis of its production, development and evolution poses as a problem of the criminal law of our country.This Article starts from the definition of Crimes Committed by Mafia-style Criminal Gang. Collecting and analyzing different kinds of definition of Crimes Committed by Mafia-style Criminal Gang, the Article holds the viewpoint that the definition shall be given from both aspects of criminology and criminal law. In the second chapter, the Article analyzes, in aspect of criminology, the ordinary causes of Crimes Committed by Mafia-style Criminal Gang, among which are economical, political and social elements. In economic analysis, the article mentions not only the influence of development, rich-poor gap and disequilibrium of districts but also the one from senior economic form. In political analysis, the article put weight on the relation between the development of rule of law and Crimes Committed by Mafia-style Criminal Gang. The analysis of the characteristics of Crimes Committed by Mafia-style Criminal Gang also startes from two aspects of crime law and criminology, and concluded in criminal law and essence characteristics. The analysis of criminology serves for the research in criminal law and will be a significant part of the research in solving the problem of Crimes Committed by Mafia-style Criminal Gang. The third chapter gives a brief introduction of the criminal law concerning Crimes Committed by Mafia-style Criminal Gang in our country and analysis the defects of the legislation. Based on the aforesaid analysis the article provides some advices on both criminal law and criminal procedural law in the fourth chapter.On the method of research, the article combines macroscopical and microscopical methods, and branches into criminology, criminal law, sociology, psychology and law-economy. Besides, the experience of foreign countries is also considered. All of these will serve for the outcome of reasonable analysis and feasible advice.
