Our country about the Mafia Crime Legislation in 1997 issued the "criminal law" article 294 th for the beginning,then has introduced the legislative and judicial interpretation related to the criminal law amendment(eight),has made great progress in legislation,such as the crime is more simplified,sentencing more exquisite,adding to the organization,the leader the punishment also increased the punishment,also set up the property punishment etc..At present,the defects in legislation are mainly reflected in the definition of law and the establishment of accusation.The lack of the definition of law makes it difficult to identify the organizational characteristics,economic characteristics,organizational characteristics and illegal control of crimes organized by Mafia like organizations.The legislative perfection of criminal syndicate crime in China includes perfecting the criminal law article of the underworld organization crime in China,adding and perfecting the accusation and scope of underworld organization crime,and reconstructing the criminal law enforcement procedure of the underworld organization in China from the procedural law.
