The Study On Chinese Land Expropriation Compensation And Relocation Institution During The Urbanization Process

The reform and opening up polices have impetuous the rapid development of China's national economy and all-round social progress. It also brings the new chance for the rapid urbanization. While the urbanization promotes the productive forces, it has also hastened the birth of a number of new social groups - landless peasants. The rational compensation for the landless peasants is related to the important social problems which are increasing the income of agriculture, the farmers' income and the stability of rural areas, and even influence the possessing of urbanization. At present, there are a lot of problems in the land-request compensation and resettlement of the landless peasants. It not only wastes the farmland, but also lead to the loss of fanners' interests, or even affect the social stability.The paper starts on the outstanding problems of land-request compensation and resettlement in the possessing of urbanization in recent years. The guide theory of this paper are the incomplete property rights theory, the value of utility, the renting price theory of Marxism and fairly burden theory .And the research methods are political science, public management, economics and other disciplines of basic theory and analysis methods. By using those methods, it analysis the principles, criteria, the rational of resettlement, the system of distribute all the interests parts, ways of regulating relief and the feasibility of the resettlement of landless peasants. By the comparison between our polices and parts of developed countries and Hong Kong and Taiwan's polices, find out the deficits of China's current system, especially the insufficient of the protecting the legal rights and interests of landless peasants. Then by learn the rapid theory and experience of those developed countries, Hong Kong and China Taiwan, and considering the China's conditions, put forward the basic target and specific ways of reforming and improving the existing land-requestcompensation and resettlement system.
