The Conflict And Coordination On Regional Trade Arrangements And The WTO Rules

In recent years, the regional trade arrangements have a rapid development , coexistence and development become the basic characteristics of the world economy in regional trade arrangements and represented by the WTO and the multilateral trading system. On the one hand, regional trade arrangements as well as the added of WTO that they have compatibility; On the other hand, the WTO in the world economic order and the sense of international law on regional trade arrangements necessary regulatory system, including the GATT Article 24 and its understanding, GATS Article 5 and the Authorized provisions. Based on the WTO framework of regional trade arrangements and the legal basis for the establishment of legal norms, in combination with practical, and make full use of legal rules relevant WTO agreement on the WTO and regional trade arrangements between conflict analysis to identify reasonable solution.The article from start on regional trade arrangements, the focus of the concept of legal documents on the basis of interpretation of the regional trade arrangements in some of the relevant system and the WTO legal rules for comparative analysis, comparison of the proposals. The full text is divided into four parts, the first chapter is mainly on regional trade arrangements outlined on the development of regional trade arrangements, the role and main content of the second chapter describes the framework of the WTO regional trade arrangements and the basis for the legitimacy of the existing problems; Chapter III from the dispute settlement mechanism, the MFN principle, rules of origin in these areas, devoted to the analysis of regional trade arrangements and the WTO framework of the syste-m of conflict; Chapter IV based on the previous three-part exposition of regional trade arrangements and the conflict between the WTO, pointed out that the regional trade arrangements and the WTO rules and the possibility of the need for coordination of regional trade arrangements and the WTO rules to coordinate a preliminary idea on how to form the two more closely related to the link legal measures and strategic initiatives.This paper focus on the innovation lies in the microscopic analysis of the provisions of the relevant WTO provisions ,carefully study the law and its practice in the background on the WTO to be inspected, and reveals the WTO and regional trade arrangements intergovernmental relations.
