| As our country's water resources allocation system defects, was wanton waste of water resources and faced with a serious shortage phenomenon. To solve the water problem, the key lies should establish a market in the allocation of water resources through water trading legal system. Because our water rights issues for the law research in its infancy stage, water trading is legal system construction of China's socialist market economic development, China must solve new problems. In this paper, using the method of economic analysis, systematic analysis, comparative analysis methods and empirical analysis method, in a bid to build a water rights for our country's legal system transactions.This paper is divided into four parts.The first part of the water rights from the start with the basic theory, expounded the concept of the right to water, and object classification, larger view of the current controversy several doctrine, clear water, including water resources should be the right of ownership, including the right to use a group of rights ; then expounded the object of water rights trading, water made products are not the object of water rights transactions, and will be tradable water rights and water rights prohibit transactions made a clear distinction.The second part first introduced the United States, Australia, Chile three representative national water rights trading experience and, based on this experience to compare countries, and to analyze its water right transactions in China and draw on the inspiration of.The third part, on the country's system of water rights trading status, analyzing China's existing water rights trading system in existence and the problems impeding water right transactions flaws.Fourth part in the legislative level to the water rights to clearly defined, and from water rights trading market and the establishment of norms and the right to water prices on China's system of water rights transactions to conduct a comprehensive legal system building.
