A Legal Analysis Of The Ownership Of Parking Plots In Residential Blocks

Along with our country's urbanization and the rapid growth of our national economy, automobiles have made their way into people's lives and homes. As the spot for people to park vehicles, parking plots'additional functions have become more and more important. In analyzing the ownership of modern buildings, the ownership of and the access right to parking plots are one important issue, which involves residents'rights and draws public's attention. It has also been a focus in the legislation process of the Real Right Law of the PRC, as it may results in conflicts due to the absence of relevant laws and acts as well as the inadequate supply of parking plots. In this paper, three principles and three stipulations concerning its ownership will be put forward on the basis of an analysis of relevant stipulations in the Property Law, as well as in view of theories for specifying the ownership of buildings in China and similar laws and theories in other countries. After that, a classification and specification will be made for different parking plots in China.
