The Research On The Ownership Problem Of Residential Parking Space

With the rapid development of economy, our country residents living standards improve, for many residents to buy private cars is no longer difficult to realize the dream,the ownership of private cars increasing year by year, however, in reality for the construction of the parking space is simply too slow to keep up with growth of the private cars, the existing parking space is hard to meet people’s normal parking demand, for a parking space ownership and use has triggered a series of disputes. Although the property law passed in 2007 on the ownership of parking space, but the rules too principle, can not fully meet the needs of dispute resolution in the judicial practice, define the parking space ownership problem remains to be further studied and discussed.In this paper, through the comparative analysis and empirical research method, focus on residential area parking rights define the problem in our country. The fourth part first analyzes the present status of a parking space right ownership, then summarizes and analyzes the current relevant legislation situation of residential parking Spaces, and finally analyzed the rationality of China’s "property law" the 74 th and shortcomings. The fifth part focuses on China’s residential area parking rights definition put forward the corresponding perfect Suggestions, such as law, improve the system of registration, etc.
