Teacher's discipline right is a power of punishing the students because of their faults in the education field, to some extent, it is also the teacher's right on the basis of his/her professional identity. Discipline can make students feel regretful for their wrong behaviors by stimulating their bodies and hearts; it can avoid them doing the wrong behaviors again. It not only ensures the normal order of teaching, but also gives the better development of the students' personality. So its effect require teacher practice discipline right correctly.But in the educational reality, with the student's right emphasized, many people have a wrong recognition to the education discipline. On one hand, some of them adore appreciated education; they think that the students can develop better only by the way of encouraging and praising, so they abandon discipline education. On the other hand, some of them identify the right discipline form with corporal punishment; they think that it is very harmful for the students. The wrong recognition affect the teachers apply the discipline right to the education field badly, more and more teacher give up the discipline right because of the great pression. The teacher's authority is ignored, the effect of the teacher's discipline reduces.With this problem, the paper has a study for the running off of the teacher's discipline right based on necessity of teacher's discipline and the relation between the teacher and the students. The paper is divided into five chapters, the first chapter is the introduction of the paper, gives the background, value and methods of the research. In the second chapter, the author introduces the main conceptions and relative theories. In the third chapter, based on the results of the survey the author summarize the current situation of the running off of the teacher's discipline right, and analyses the effect it can bring from the science of education and law aspects. In the forth chapter, the author analyses the causes of the phenomenon from the inside of education and society aspects. The fifth chapter is the ending, based on the former scholar's achievements, the author gives the principles and suggestions in the process of controlling the running off of the teacher's discipline right.
