A Research On The Problem Of Teacher's Appealing System In China

The teacher's appealing system is an important part of the system of managing school by law in china. Meanwhile,it is the relief mechanism for legal rights that teachers must achieve. Teacher's appealing system is established by the Teacher's Law as a specialized legal relief to protect the interests of teachers. The 39rd article of teacher's law of people's republic of china clearly stipulates the right of complaint of teachers. When teacher's right was impinged, teacher can appeal and plead through this kind of system, teacher's appealing system is a weapon when teacher's right was invaded. Teacher's appealing system provide a positive condition for teaching and scientific research. However, the current teacher's appealing system in our country is not perfect and has many flaws in the enaction and in the practice as well. So the teacher's appealing system need to be amended and be perfected.But the teacher's appealing system in China is still in a low and incomplete stage, which has existed many problems and affect its enforcement, so many scholars have begun to conduct some researches. Yet there's no systematical work on the teacher's appealing system and proper measures of complaints system. As to the presenting problems of the teacher's appealing system,how to perfect the teacher's appealing system has made the exploration in the thesis .This paper is to explore and perfect the teacher's appealing system in our country.This paper has adopted such research methods as document reference, comparison study ect., studied from the basic questions and basic law acknowledged by teachers, defined the words:complaint, complaint right and complaints system, clarified the theoretical foundation of the teacher's appealing system, feature and position of teacher's appealing system, and analyzed the significance of the teacher's appealing system establishment. This paper has also analyzed the problem on its legislation and practice by learning the theory and experience from foreign countries and Taiwan district and has provided the measure on perfecting teacher's appealing system in china. The aim of this study is to perfect teacher's appealing system, to protect teachers'legal rights and to build legal campus management and harmonious campus.
