Teachers’ right to discipline has always been a hotly discussed issue that has attracted much attention from the society.With the development of new media,a series of incidents in which teachers punish students with serious consequences have continuously come into everyone’s field of vision.People’s discussion on whether punishment is still in line with the needs of the times has gradually changed to "dare to control and cannot control" and "Exploring the balance point of the contradictory status quo of "excessive punishment".In December 2020,the "Primary and Secondary School Educational Disciplinary Rules(Trial)" promulgated by the Ministry of Education clarified the concept of "discipline" in the form of legal norms for the first time.Based on the "Trial Regulations" as a starting point,this article combines the development and evolution of punishment to study the punishment system for primary and secondary school teachers.The article is divided into four parts:The first part:Introduction.In the first part,guided by problem awareness and based on the "Trial Rules",the direct prohibition of "corporal punishment" in the"Trial Rules" and the boundary issues of "corporal punishment in disguised form" are discussed.Furthermore,the research methods and innovations are also explained in the introduction.The second part:the historical evolution and legislative status of teacher punishment.In this chapter,longitudinally based on the historical time division of our country,we will discuss the four stages of the teacher’s discipline power experience in our country from the three time dimensions of ancient society,modern society and modern society;horizontally,using the method of Chinese and Western comparative research,The evolution of the discipline of teachers in the West runs through it.In addition,through the analysis of the legislative status and experience of teacher’s disciplinary power in China and foreign countries,it lays the foundation for the definition and nature of the following concepts.The third part:the related concepts and nature of teachers’ disciplinary power.According to Maslow’s demand theory and punishment ladder theory,from the subject,object and specific behavior of the teacher’s disciplinary power,the "teacher disciplinary power and school disciplinary power","disciplinary and corporal punishment",and "general disciplinary power and bad behavior disciplinary power".Three groups of concepts are defined,and on the basis of the definition of the concepts,the nature of the teacher’s right to discipline is differentiated.The fourth part:Suggestions on the improvement of the punishment system for school teachers’.First,analyze the implementation dilemma of the teacher disciplinary system based on the "Trial Rules";at the same time,discuss the reasons for the above dilemmas around the unclear focus of the regulation of teacher disciplinary powers,the unclear stepping of punishment for bad behavior,and the separation of the disciplinary subject.And explore suggestions for perfecting the system. |
