Cost-Income Analysis On The Crime Of Bribe

The crime of bribe is a kind of familiar crime with the misuse of public power in the criminal field. It is not enough obviously if we just use the justice and equity only to research and prevent more and more complex and covert bribe crime, under the circumstance of more and more seriously bribe crime. The theory of cost-income in criminal economics provides a new angle of view to research bribe crime; with the help of cost-income theory based on the theory of rational choice, for show us that the process of crime decision-making is a kind of process in which comparing cost with income. For this reason, it is necessary to increase the cost and to decrease the income of bribe crime, directed by cost-income theory based on the theory of rational choice for the purpose of preventing the bribe crime.This dissertation, guided under the main idea of cost-income theory based on the theory of rational choice and gone with the crime of bribe, brings forward the efficient methods to prevent the crime of bribe, according to the theory of cost-income. This dissertation consists of three parts. The first part makes a brief introduction of the conception and history of the crime of bribe. This part mainly introduces the history of bribe crime legislation since open to the world in 1978, and the characters of bribe crime under the angle of cost-income theory.The second part is the research of bribe crime under the angel of cost-income theory, which is the mainly part of this dissertation. The first section mainly introduces the conception of cost-income theory, which mainly consists of two basic theories which are rational choice and cost-income theory. The second section takes the bribe crime case of Liu Ketian, who is the former governor of Liaoning province, to explain how to analyze bribe crime with the help of cost-income theory.The third part is enlightenment of cost-income theory for the purpose of preventing bribe crime. After the analysis of the first two parts to the crime of bribe, this part brings forward the method to prevent the crime of bribe according to the cost-income theory based on the theory of rational choice, which is the end-result of this dissertation.
