Research On The System Of Customs Protection Of Intellectual Property Right In European Union

Customs protection of intellectual rights is a popular means to protect intellectual rights among countries, especially among the West. It develops as the international trade grows. Its status and function is more obvious especially under the circumstances of illegal trades such as pirates and counterfeits in the international trade. It is an administrative protective means. The European Union has both advanced ideas of intellectual rights protection and relatively developed experiences and exercises on legislation and enforcement. We have a lot to study and learn from EU customs protection of intellectual rights.This thesis offers an examination of the origin, development and integration of EU Customs Union and an analysis of the important role it has played in the establishment of a uniform system of EU customs protection of intellectual rights. This thesis also offers a deep analysis of the background and law origin of the customs protection of intellectual rights and lays the emphasis on the aim, content and evaluation of Council Regulation (EC)No1383/2003. In addition, this thesis studies the main content of TRIPS Agreement and its effects on EU. By comparison, China established the customs protection of intellectual rights later and does not have a sound law system. The customs are in a great need to improve their enforcement capability. The intellectual rights strategy and sense of customs protection of intellectual rights of enterprises are very low. We can learn a lot from the EU customs protection of intellectual rights with the combination of our national conditions. Therefore, the author studies the status quo and problems of China's customs protection of intellectual rights in the last part of the thesis. In conclusion, the thesis offers the enlightenment of EU customs protection of intellectual rights to us.
