In today's international trade, the relationship between the trade related to the Intellectual Property Rights such as trademark, patent, copyright, service marks and the international trade grows closer. However, the Intellectual Property Rights is countering serious violation because of the deluge of counterfeiting and piracy while it promoting the development of world economy. So far, the world, especially the developed countries ledding by the United States is positively taking legislative, administrative, and judicial or customs relief mode measures to protect the Intellectual Property Rights by promoting signing worldwide Intellectual Property Rights protection unilateral, bilateral or multilateral agreements.Although the contribution of China's Intellectual Property Economy to the society is not much, China has been a member of the World Trade Organization and the import or export of goods has played an indispensable role on the development of China's economy. Several trade frictions proposed to China, especially the one proposed by the United States because of their thought that their intellectual property rights have been infringed resulted in several rounds of China and American Intellectual Property Rights negotiations. From the outcome of the negotiations, our country strengthens the protection of Intellectual Property Rights, but much legislation is not necessarily beneficial to China.The United States is the first country to take customs protection measures for the Intellectual Property Rights whose legal system related to the Border Protection of Intellectual Property Rights is much more mature in the world. In particular, The U.S. Customs accumulated much experience about the Border Protection of Intellectual Property Rights and have an important impact on the Customs and Border Protection of Intellectual Property Rights in many other countries. This paper attempts to perfect our country's Customs Protection of Intellectual Property Rights through introducing the United States Customs Protection of Intellectual Property Rights system and the experience of the United States Customs in the protection of Intellectual Property Rights comprehensively and systematically.
