| In recent years, online game has become a rising industry, which filled with opportunities and challenges. As an emerging industry, it influences correlative industries' development. Compares with other countries ,Chinese online game industry expands in an faster speed,it play an important part in our country's economy. However,with the development of the online game industry,the infringement of the online game increases day by day,such as the behavior of infringing upon the online game's copyright and trademark rights, the player's legitimate rights and so on. The consequence of the infringement is getting more and more serious, but in today's China, the online games have many blanks in the law. If we cannot regulate the infringement, it will certainly to hinder the development of online games industry. Therefore, perfecting the legal protection measures of our online games has already been a problem to be solved urgently.This article altogether is divided into three chapters. The first chapter carries on the outline to the infringement of online games, firstly we analyze the present situation of the infringement online games, secondly we define infringement of online game, finally we analyze the main form of the online games'infringement. The second chapter analyzes the present problems, which exists in the punishment on the infringement of online games. The last chapter conducts the research on the legal rules and regulations method to how to guard against the online game's infringement. Firstly, we discuss the responsibility principle of the infringement of the online games,secondly, recommends the legislative Model of the online game of China, and then we analyze how to establish and perfect online game's legal norm from the existing legal framework ,finally proposes the safe mode of online game.
