Study On Legislation Of Preventing The Pollution Of China's Urban Wastes

The rapid urbanization has come with the well-developed economy, which made the pollution of urban household refuse the malignant tumor of social development. Because of the close relationship between the individual life and the refuse, it is of great significance to protect and improve the urban environment in the interest of proceeding economy with smooth progress and establishing a sustainable society.In China, due to various factors such as the imbalance development of regional economy and differences in dietary habit, the urban garbage is characterized by the big basic numbers, visible change of elements with the seasons, and fast renewal of the sort. Besides, as a result of the shortage of the garbage disposal technology, as well as the insufficiency of legislation and relevant coordinated regulation, the increasing pollution of land, water and atmosphere has become one of the main obstructions for the social development. However, while paying attention to the harm bringing by the waste, we should also find the extraordinary economic benefits. It is an important role in solving the waste of resources and saving social costs to recycle and reuse the useful elements of the urban waste.As we are still at the edge of preventing and remedying urban garbage pollution by legislation, it exist many deficiencies and applicability in concrete laws; although there are many regulations about city waste in existing laws, such as the basic law and individual laws. In order to solve the environmental issue caused by urban refuse as soon as possible, we should bring our initiative into full play and the scientific concept of development as a new guiding ideology on legislation, which is presented after our country introduced the advanced experience on prevention of the municipal waste from developed countries as the US, Germany, Japan and other ones, while combined with our present conditions. As implementing the rules from the new Law of Prevention and Control of Pollution in an all-round way, we are aimed to build China into a recycling-oriented society with resources used sustainably by safeguard measure of laws. Therefore, we need to take positive steps to make up the unrecognized spot in law, develop other supporting laws on preventing the urban waste and establish various specific legal systems adapt to the development of the market economy to construct our legislative system on preventing and remedying urban household refuse unceasingly.
