On The Special Constitutive Elements Of The Crime Of Money Laundering

Compared with these traditional crimes, the crime of money laundering is a new one. But it develops in a tremendous speed and has done more and more harms to the society.In this article, I focus on the special constitutive elements of the crime of money laundering, and expect, by comparing them with these which is in other countries and international conventions, to polish them in our criminal law.There are three chapters in this article. In the first one, I mainly discuss the serious social hazardous nature, the value analysis of the criminalization and the history and present situation of the crime of laundering. In the second one, I suggest to enlarge the range of the predicate offence of laundering. In the third one, I suggest that the subject of laundering should include the predicate offenders, the subjective elements of laundering should be direct intention, the knowing of crime should include the knowing in fact and the knowing which is deduced from the facts, and that the standard of confirmation of knowing should be the unity between the subjective and objective conditions.
