On The Admissibility Of Judicial Expertise And The Rules Of Examination

The evidence admissibility of judicial expertise is an indispensable part of the problems on the Chinese criminal evidence system. While The Decision on the Management of Judicial Expertise by Standing Committee of the National People's Congress sets the specification and norm for the judicial expertise, the admissibility still remains a big problem. This thesis points out that the corresponding rules of examination should be made on the admissibility of judicial expertise, and the rules of exclusion as well should be stipulated on the evidence of judicial expertise. The system that the expert witness should be in the court is under construction, and the cross-examination of the judicial expertise should be enforced. Finally, some reforms are to be made on the management of the judicial expertise system, thus to perfect the conception of the system on the judicial expertise of judicial expertise in China.
