With the developing of process of urbanization and the deepening of reform of urban housing system, some kinds of residence areas appear in China. Accompanying with this, the industry of property management appears and develops at a great speed . Property management firstly must be the owner's self-rule by the owner's self-rule organization. However, the wholly and correctly knowing the owner's self-rule organization is very important and substantial for ordering all kinds of legal relations in the action of property management, setting up and developing the consummate owner's self-rule system, ensuring coral status of the owners, which is beneficial to normalizing the modern property management system and enhancing the healthy development of the industry of property management in China too.The whole article is divided into four chapters.In the first chapter, the legal status of the owner's self-rule organization in residence area is analyzed. At first, the related fundamental concepts are introduced. Secondly, the characters and the organization form of the owner's self-rule organization are introduced. At last, special emphasis is put on analyzing legal status of the owner's self-rule organization.In the second chapter, the operation system of the owner's self-rule organization is tried to analyze. At first, the legal relations in property management are introduced on theoretical position. Secondly, special emphasis is put on the operation practice of the owner's self-rule organization according to social survey.In the third chapter, the legal problems in the owner's self-rule organization and its operation in residence area are analyzed. At first, the prominent problems of the owner's self-rule organization is expounded according to our country's current law: Firstly, it is not a problem whether the owner's group has been set up. Secondly, it is a vague stipulation of the owner's self-rule organization. At last, the legal status of the owner's self-rule organization isn't clearly stipulated, which leads to confusion of legal relations in property management, so the non-corporate group should be given to the status of the Owner's Committee. Secondly, special emphasis is put on such prominent problems during the operation of the owner's self-rule organization as the problem of the owner's taking part in and the Owner's Convention, the problem of the operation of the Owner's Committee, the problem of the property management fees, and the problem of the relations between the owner's self-rule organization and related subjects. Those exiting problems are not beneficial to effective operating of the owner's self-rule organization.In the fourth chapter, some suggestions are given about how to solve the problems of the owner's self-rule organization in residence area. There are some proposes based on the legislation and judicature position.
