Property Management, Owners Of Autonomous Legal System Research

The proprietary lights belong to the owners in real property management, who are in the center and first position of it Therefore, it is of vital importance to set up and develop complete and perfect owner self-ruling legal system for the development of property management trade and property management system. On May 28,2003, the State Council issued The Property Management Regulations, which basically sets up the owner self-ruling system. However, it is far from complete and perfectIn view of this,the author of this article chooses the subject "study of owner self-ruling legal system in property management". After analyzing the present owner self-ruling system in China, the author endeavors to straighten out various legal relationships in owner self-ruling, design a suitable self-ruling organization and provide some suggestions in constructing an owner self-ruling legal system applicable in China's particular situation.The article first defines the concept, nature and principle meaning of owner self-ruling. Then it is analyzed that relevant provisions in the Constitution (namely, citizen's private property rights and democratic rights, regulations concerning legal principle and democratic principle, the condominium ownership theory of buildings) provide necessary theoretical legal support to the setting up of owner self-ruling system. On this basis, the article studies the owner convention, owner serf-ruling organization, legal relationship and legal duties of owner self-ruling respectively, and finally constructs the basic framework of owner self-ruling legal system.
