An Report On Legal Consciousness Of Minorities In Linxia Hui Autonomous Prefectures

Legal consciousness is the thought, view, knowledge and psychology of the legal phenomenon. It is a kind of social consciousness. Governing the country according to law relies a lot on the modernization of legal consciousness. Without the legal consciousness which adapts with modernized legal system, to rule of law is impossible to be achieved.Almost the whole minority in Linxia Hui Autonomous prefectures believe in Islam faithfully, which influences the legal consciousness of minorities deeply. Islamic law is not only their external behavior norms, but also becomes their inner conviction, which makes legal consciousness of local minorities has distinctive ethnic characteristics. And Linxia is an ethnic region, located in the west of china, where the economy is less developed and the extent of industrialization is poor. These make the situation of the legal consciousness of minorities in Linxia more complicated. The investigation and study of the legal consciousness of minorities in the area of Linxia Hui Autonomous prefectures offer reference for the other areas whose residents also believe Islam.In July, 2006, we, including me, the tutor and other students, made a survey in Linxia Hui Autonomous prefectures. Minorities in the area of Linxia Hui Autonomous prefectures whom we released questionnaire to were taken as the study object. And cruising data were fitted and made statistics. This article is precisely completes in the foundation of the primitive cruising data. From analyzing, the author draws the conclusion as follow: Lack of knowledge, corruption and other illegal deed in law enforcement and judicature, and affects from Islam are main problems of minorities' legal consciousness in Linxia. On the basis of above analysis, the author puts forward to some suggestions, including enhancing the education, improve the situation in law enforcement and judicature, and guide the religion in conformity with the our society. These measures can improve the level of legal consciousness of minorities and promote the process of building a socialist country ruled by law.The article is divided into six parts altogether.Part one is about concept, structure and classification of legal consciousness.Part two is about basic situation of questionnaires.Part three is about the status quo of legal consciousness of minorities in Linxia Hui Autonomous prefectures.Part four is about the reasons that restrict the improvement of legal consciousness in Linxia Hui Autonomous prefectures.Part five is about some proposals that put forward by the author.
