On The Hygiene Administrative License System

The content of the hygiene administrative license is closely linked with people's health and the progress of society. It is the hygiene administrative license system that is carried out to protect relevant public hygiene trades and civilians' healthy. But the existing hygiene administrative license system is not complete. Since the society is in constant progress and development, the relevant hygiene administrative systems ought to keep pace with times. Meanwhile, after the implementation of "Administrative License Law of the People's Republic of China", it is also a necessary subject for the hygiene administrative departments to think rationally of how to reply it. Some serious hygiene security cases that happened in recent years have exposed some problems existing in hygiene administrative license, too. Therefore, it is significant and necessary to study current situation of hygiene administrative license, find out existing problems and probe reform countermeasures. This will certainly help to promote administering the state according to law, improve administrative efficiency, and promote the development of hygiene trade and public health.In this thesis, some overviews of our country's administrative license and hygiene administrative license are presented briefly at first. Some rough introduction of the experience and situation of public health management and supervision in some foreign developed countries is given as a means of drawing lessons from for China. Then, from angle of reality then, the author expounds three reasons for the predicament that hygiene administrative license in our country has suffered. The reasons are internal deficiencies on the system, external predicament on practice, and potential dangers caused by abusing discretionary right in the hygiene administrative license behaviors both on entity and procedure. Finally, from visual angle of feasibility, several suggestions and ideas for the reform of the hygiene administrative license system are put forward in order to facilitate the administrative system of hygiene in our country to develop in a harmonious and healthy direction.
