The Study On The Trial System

The trial system is a unique justice system.Over the years,as the highest court within the trial,the judicial committee has played an important role in trial experience to solve difficult cases,unifying standards of justice, guaranteeing the quality of handling cases,the realization of justice and resisting adverse judicial environment for a fair judicial interference.However, as China's economic and social development,the existing judicial committee system has been unable to completely meet the needs of the changing situation. In recent years,with in-depth reform of the judiciary,law experts and the judiciary on this system began more thinking,involving the nature of the judicial committee system,functions,composition and operation,etc.,mainly for the trial reform of the committee system.under this background,in 2005, the Supreme Court issued the "People's Court for the second five-year reform" and determined the reservations of the system as one of the four key reform tasks.This issue has caused great concern of the judiciary and the academics.The mission of this paper is that based on the retention of the trial system, the author with experience of many years in the work of the Court,a judge from the perspective of China's special judicial committee,conducted a detailed inspection on the system,analysis of the system and its advantages and its shortcomings.in considering China's current and changing social conditions abroad and in the light of the relevant concepts and systems based on the focus on the reform of the system,combined with practical ideas,the author analyzes and evaluates and puts forward her own views about the improvement of the system.
