A Discussion On The Right To Labour Reward Of Peasent Workers

Peasant workers is a particular social phenomenon in the period of rapid social change, the formation of peasant workers is a process of social and historical change, the emergence of peasant workers has historical reasonableness and advanced significance, which has far-reaching effects on the progress of China's urban and rural regions of space economic and social development.The right to labor reward is the basic rights of workers under the conditions of market economy and one of important labor right which the law give the workers , the realization of which is related to survive and develop. Workers realize the right to labor reward is an important form of wages, although China's constitution and labor laws on the form of wages paid and wage protection system made expressly provided, but in real life, that employing units arbitrarily deduct and owe to peasant workers' wages occurs from time to time, and there is an upward trend, not only for the survival of life itself posing a serious threat, but also on social stability and harmony causing very serious harm.Although the cause of the arrears due to various reasons, but this is only from a legal point of view, from the description of the status quo and the analysis of cases, in-depth study of peasant workers wage arrears have profound social causes, and on this basis to propose solutions peasant workers owed wages corresponding measures.In this paper, through the study I reached the following conclusions: (1) A large number of peasant workers' wages are owed , in summary, which reflects on following aspects: First, labor time is long and labor intensity is heavy; second, the level of wages is low and increases slowly; third, signing of the contract is slow, peasant workers' rights cannot be got protection ; Fourth, skimping with disguised form and be in arrears wages is quite grave.(2)A large number of phenomenon of being in arrears peasant workers' wages has complicated cause, both legislation aspect and enforce and judicial aspect, which has brought large obstacle to the peasant workers for getting labor wages by the way of legal action, has led to common current situation in arrears of peasant laborer salary.(3) Peasant workers' salaries being in arrear heavily have been infringed the right of labor reward gravely, and infringed the right of survival and development . Therefore, we must build perfect relief system, to protect peasant workers' legal rights. In the aspect of relieving system, I issue suggestions from the legislative, executive and judicial aspects.
