The Current Situation And Improving Of The Qualification Credentials System Of The Deputy To The People's Congress

The qualification credentials system of the deputy to the People' s Congress is a system that to make sure that the deputy whom had been elected is up to the standard by some institution, generally is the deputy qualification credentials committee. At present, the scholars of our country didn' t pay enough attention to this problem; the theory study of this problem is restricted extremely. They didn' t have a consensus of opinion about the intension, status and the drift of this system, and also they didn' t come to a stipulate on legislation.This study analyzed the status of our country firstly. Firstly, this study stated the relationship between the election of deputy- of the People' s Congress and the system of qualification credentials. The system of the People' s Congress is of great values and functions in china. There are two ways of the election of the People' s Congress' deputy in our country: one of that is direct election, which is used in county and country only; and the anther one of that is indirect election, which is used in the election process above county only. No matter which one is used, it' s necessary to qualify the candidate' s qualification. The qualification credentials system of the deputy is the important composition of election system of the People' s Congress Deputy, which of great functions and values for election of the People' s Congress Deputy. Which is embodied by the following respects: firstly, the qualification credentials is the premise of making sure that the candidate is of the right qualification. Secondly, the qualification credentials system is the important mechanism for the deputy of the People' s Congress to enter or retreat , is the important way to improve the capability of the deputy of the People' s Congress and also the reform the qualification credentials system is the key link of the reform of the People' s Congress System. Thirdly, this study stated the status, characters, compositions, functions and so on; and also stated the now-working system of qualification credentials of the People' s Congress deputy and analyzed the shortcoming of the system. Fourthly, this study stated the substances of the qualification credentials system of the deputy to the People' s Congress and believed that at present the substances of our country' s qualification credentials system of the deputy to the People' s Congress is including the following aspects: the identifications of the candidates' qualification whom are elected, or elected by anther special process, or elected by a by-election process, or demands an end to a candidate whom are elected. This paper studied those separately. Finally, this paper studied the way how to establish a fail and reasonable process of the qualification credentials system of the deputy to the People' s Congress, and believed that it has some important values as fellow: that is make sure that the consequence of the qualification credentials is fail and reasonable, and also the efficiency of that is in promoting. At the same time, this paper stated that we should give consideration to both the reality and predictive, and also had a substantial evidence analyses about the now-days qualification credentials system of the deputy to the People' s Congress of our country.On the base of analyzing the status of the qualification credentials system, this study gives some measures to reform and improve the system. Including the following measures, firstly, we should improve the power of the deputy qualification credentials committee, such as entrusting the deputy qualification credentials committee with much more power, clear-cut the relationship between the qualification credentials committee setup and administrative body and entrusting the deputy qualification credentials committee with much more responsibility. Secondly , increasing the substance of the deputy qualification credentials committee , take the electing process to the contrast of qualification credentials, including the candidate' s political consciousness, motivation, capability of participating in government and political affairs, behaviors and whether he or she want to participate in the election and so on.; Not only investigating whether there are illegal activities in the process of election but also investigating whether the candidate have any illegal activities; Establishing the system of pre-changes of the qualification of deputy. Thirdly, improving the process of deputy qualification credentials, including the fellow measures: establishing the integrated procedures; making sure the process is fair; establishing the lawsuit mechanisms. Finally, improving the qualification credentials system of country and town.
