Research Of Acquiring The Qualification Of Modern Chinese Lawyers

The system of obtaining the qualification of lawyers in modern C hina is an important part of the modern lawyer system,which has been gradually formed and developed in the process of modern legal system reform and social reform.This paper,based on the traditional C hinese legal culture,collates and analyzes the relevant historical materials,and analyzes the development and implementation of the system for the acquisition of lawyer qualification in modern C hina with the help of the results of the textual research on the legal history,and discusses the reasons for the problems in the process of implementation.We hope to deepen the research on the system of obtaining the lawyer qualification in modern China.It can not only deepen our understanding of the historical process of obtaining the system of lawyer in modern C hina and the problems in the process of implementation,but also provide a historical reference for the improvement of the modern judicial system including the lawyer system.This article mainly includes the following parts: The first chapter is the introduction,which mainly introduces the reaso ns for the selection of the topic,its theoretical and practical significance,the research status quo at home and abroad,and the research methods.The second chapter focuses on the examination mode of the modern lawyer qualification,analyzes the legislative changes of the lawyer examination system,and analyzes the reasons for the failure of the effective implementation of the lawyer qualification examination system from five aspects: the political environment,the economic environment,the traditional judicial concept,the legislative conflict and the exercise of the examination power.The third chapter discusses the legislative changes and the implementation of the exemption system of modern lawyers' qualification,and focuses on the analysis of the influence of the personnel constitution,the legal education and the legislation on the examination and verification on the quality of the lawyer team.The fourth chapter mainly introduces the development track,the implementation situation and the double influence of the legal activities of foreign lawyers on the system of obtaining the qualification of lawyers in our country.Finally,China has recently promulgated the law on the national unified legal professional qualification examination,and it still in the stage of development.This paper studies the system of modern lawyer qualification,so as to provide some enlightenment for the current national unified legal vocational qualification examination system.
