Research On Labor Standards Under WTO

Trade and labor standards has always been the hot topics for international trade discussion, it related to lots of interest group and had include economic,political and law sources. Whether labor standards should be incorporated into the WTO has become one of the hot topics for discussion in WTO. By now labor standards have not been written into the new round multilateral negotiations. But in regional negotiations,in bilateral negotiations and in unilateral legislation it has gained a breakthrough. These progresses are sure to accelerate international trade combining with labor standards in multilateral trade negotiations.China should choose the right attitude to the problem. It not only relates to our economic development, but also our ability in negotiation.This thesis was written against a background of multilateral trade liberalism. Beginning with the relation between the trade and the labor rights protections, the thesis elaborated the debates and practices on the hook between labor problem and international trade systematically .Looking for the protection of labor rights under the WTO frame ,we analyze the possibility, necessity and inevitability of bringing the labor problem into WTO. Except that we expound and proof the system proposition.Aiming at trade and labor problem becomes strong contact to our foreign trade, and the labor relations in our society become out of balance and society are out of harmony, today China have already could not avoid the labor problem. Along with the progress of economic globalization, the key lies in the solution which can be accepted by both parties .It is very important for China to adopt a kind of aggressive, and practical attitude towards the problem.In the end we draw a conclusion: bringing the labor problem into the WTO frame is to set a set of system to eliminate the labor barriers to trade and to avoid the members getting the so-called comparative advantage by reducing the interior labor standards evil. On this problem China should cooperate more closely with other developing countries and strive for new labor standards that will benefit developing countries. At the same time, the developing countries can ask the developed countries to supply support, such as capital, technology and human resource.
