Legal Protection Of The Right Of Social Minority Group

Almost every country has one or more minority groups within whose national boundaries, they have some characters different from most other people in many aspects such as the race, language, religion, complexion, body constitution, sexual orientation, mindset or culture. Reserving the minority groups and admitting much more distinctive cultures and multinational social groups peacefully is one of the most important worldwide problem in the nowadays. To satisfy the wishes of the human groups with different nation, race, religion and language, and to protect the legal rights of the minority group specially, will be the basic demands of the law-ruled country. That is the respect to all collective or personal dignity and equal right, and that is also beneficial to push forward democratic participation, thereby, that will help to slow down the strained situation between different groups and individuals, and realize society harmoniously.This thesis aims at paying close attention to the rights protection of the minority groups from Jurisprudence angle. Firstly, this dissertation starts elaborations from the perspectives of the definition of minority and minority group, the content of minority rights and its justification system, so as to discuss the legal principle basis of the rights protection of minority groups here. Secondly, by applying human rights theory and equal theory, the writer attend to make it reasonable and legitimate that the minority groups'rights should be protected specially then. Having expounded the development of the international rights protection of social minority groups and the status quo of rights protection of the minority groups,this paper finally brings forward several suggestions to improve and perfect the legal protection system on the minority group rights in our country.In sum, in order to increase the social fairness and promote the social stabilization, we should solve the minority groups question practically and protect their conscientiously legal rights. If so, the whole society will take on the harmonious and vigorous situation.
