A Research Upon Legal Faith Of Ethnic Minority Areas In The Mid-south Of Guizhou Province

In Spring 1996, China established the strategic goal ---the rule of law and building a socialist country ruled by law. Nowadays we still have a long way to fulfill the task. With China's gradual establishment of the rule of law, the problem of cultivation of legal belief highlighted. Harold J. Berman said: "The law must be faith, otherwise it will exist in name only."In the real society of the rule of law, law becomes the basic appeal and standards of value and judgement .The reason is why law becomes the fundamental principles and the ways of maintaining based on the pubic common faith. Common consensus of the field of law is that it is essential to foster gradually the legal faith. From academic point of view, the paper discusses the connotation of legal faith in ethnic minority areas in Guizhou.China is a united and Multi-ethnic country. It is the starting point and destination of China's ethnic policy to achieve common prosperity and common development of all ethnic groups. Meanwhile it is the most important element to think of the ethnic minority when we make an efforts into constructing our modernized legal country. In ethnic minority areas, it is more important and urgent to set up the legal faith. In the Mid-south Guizhou province, there are nearly ten ethnic minorities, like Miao Dong, Buyi, and so on in which the population makes up 1/3 of the total one. At the same time, there are four ethnic minority autonomous counties and more than 10 nationality townships. It is a typical small settlement of China's multi-ethnic coexistence, the mixed-ethnic characteristics .With the rapid development of market economy and accelerating the process of the legal system, how are these peoples modernization of the rule of law? What is the point? Compared to the problems raised in the non-minority areas, what are the Similarities and differences? The paper analyzes the issues through the analysis of the questionnaires.After making clear that, the paper does an analysis of the reason why we should face to the issues in cultivating legal faith in theory and practice and analyzes the mentality of the people, cultural traditions and scientific nature of the legislative, judicial impartiality. there are not only the problems exsiting both Han Chinese and ethnic minority areas, but different and unique ones in the other ethnic minority areas because of its history, culture, economic situation. At last, the writer views the opinions from government and civil construction point of view. According to the analysis above and the other scholar's academic achievement, the paper gives some advisable views on how to handle the problems in the process of fostering legal faith in Guizhou province.
