Discussion On Legal Protection Of Trade Secrets

As a knowledge-based economy has become the dominant economy,it's no doubt that trade secrets in the business competition are more important than before. As a technical or operational information,trade secrets can help the holder to maintain its competitive in the market and make the biggest interests. At present,China has initially formed a legal system with "Anti-Unfair Competition Law" as the center. However,there are still drawbacks in laws related to trade secrets.This article makes a detailed presentation and analysis on concept, characteristics,scope and protection of trade secrets,by learning the experience from the United States, Germany, Japan and other countries,through historical and comparison analysis. And then expand on trade secret infringement. On this basis,this article analyses the the present situation of the trade secrets protection,and concludes that the drawbacks are unclear of the subject,unclear of the legal status,legislative fragmentation and short of punishment. In my opinion,the ways to perfect the law are to strengthen self-protection and to complete the trade secret protection law.
