Study On Farm Food Security Standard System And Legal Protection Of Hebei Province

It analyzes CAC standard system,food standard systems and supervisory legal systems of EU and US,and studies 965 food security standards released by our country,more than 2900 food industry standards(including 634 national compulsory standards),1653 current local standards related to food security of Hebei province,287 national laws and policies,and 724 local laws and policies of Hebei province.We think that enhancing the systems of food security standard and legal protection is the objective requirement for agricultural development of Hebei province.The existing problems of food security standard system include:enacting methods and system can not adapt to the requirements of food security control,the system structure and levels are not reasonable,and some standards cross and overlap,be short of standards,technological level is on the low side,and the execution strength is not enough;the quality testing systems of farm food are unsound;the management of farm products security is nonstandard;and the food security standards involving farm special products and foodstuffs cover less.From the national perspective on legal system construction,our food security law and regulation system is numerous and unorderly with low effectiveness and systematization,and the criminal protective functions run inadequately,the laws and regulations can not operate effectively,meanwhile the supporting,supervising, propagandizing and implementing system are not complete.Now the food security law and regulation systems begin to take shape,and form the adaptive systems with provincial regulations as main,special policies as assistance,and local regulations and policies as supplementary.However,with the shortage of comprehensive regulations,current regulations have distinctive levels and pieces,and represent great policy meaning but low effectiveness. With the shortage of regional speciality,it possesses some local protective meanings.Aiming at these problems and combining the features of farm food in Hebei,we propose the construction of "Hebei duality farm food security frame" including standard system and regulation system.Under the frame,establish the inner technological standard system and outer management system with the protection of supporting,propagandizing and implementing,and model security systems.The standard systems put the farm products and foodstuffs security standard system of Hebei province under the national system frame,and according to national,industrial,local and corporation standards classifies the systems to create special inner and outer structure.On the other hand,emphasize the construction of management,supporting,propagandizing and implementing,and model protection systems. On the aspect of laws and regulations,construct the duality legal protection systems including inner laws and regulations system and outer supporting,supervising,propagandizing and implementing systems as well.The inner system should stand out the feature of stress on law explanations and strict execution with less legislation.Reduce the legislations of lower and overlap levels,pay more attention to the explanations of laws and the formation of assistant regulations,and enhance the execution and the investigation and punishment on executive faults.
