Study On Law System Of International Trend Of Well-Known Trademark

With the vigorous development of international economy and the frequency of international trade, a tendency of the internationalization in well-known trademarks appears. China, as a member of the international community, has been unavoidably involved, and has been comprehensively affected and truck.Based on the legal status of China well-known trademarks, by citing a good number of related well-known trademark cases and data, and by emphasizing in practical points of view, this article analysis the effects on China that the internationalization in well-known trademarks brings, demonstrates the exiting problems and defects in the well-known trademark law of China, and elaborates the particular countermeasures which may be useful for us.This paper have three parts:Firstly, the author set forth the question of the international trend of well-known trademarks of the main reasons and its performance. Secondly, the part is about the international protection system of international treaties, and facing the international trend of well-known trademarks, the United States, France's and China's legislation on well-known trademark. Thirdly, the part mainly involve international trend of China's legal response of thinking. As to recognizing standard, the author thinks that Chinese law should make a new solution. Through the improvement of China's well-known trade marks of that system, to verify how to improve the well-known trademarks of China's system of protection.Although well-known international trademarks on the regional posed a challenge, but it doesn't mean that laws are well-known trademarks in the world reunification of the international representatives of the main interests of the developed countries, we need to look at the issue into two on the basis of Well-known trademarks choice of law. So, Facing the challenge of well-known international trademark, China's laws should be to make a positive response. This article offers the countermeasures mainly from two aspects: improving recognizing standard and legal system perfection of legislation.In addition, we also should be to strengthen intellectual property rights, patents play the important role to strengthen the protection of well-known trademarks, the network environment for well-known trademark rights of the new areas, improve the well- known trademarks on the network's legal system. Multi-pronged approach to further promote China's well-known trademarks legal mechanisms for the internationalization, and establish a social integration of relief trademark rights mechanisms.
