Research On Underground Space Rights

It has indicated that using underground space not only alleviate the contradiction between the urban development and the scarce of land, but also provide the opportunities for the urban modernization. But because of lacks the law about underground space, a series of rights and obligations which produces by the using on underground space cannot be adjusted effectively. Therefore, it is significant and considerable on the value of theory and practice about the relevant legislation of underground space rights to reach the theory of underground space rights and elaborated reasonable and necessity that it is to adjust the legal relations of underground space right by law.This article is constituted by three parts that are the introduction, the main text and the conclusion. The introduction part mainly introduced the reason, goal and significance about this topic, and then summarized situation about research on underground space rights at present, and selective analysis existence question, finally it is explanation about technique at research. So it is indicated the path for the concrete direction and the range of study on research. The textual material is composed of four chapters. In the first chapter of underground space right's limits, explained to the underground space right's basic concept and the characteristic, and explained that theory and practice reason about produces reason on the underground space rights, then summary the outline of the underground space power's logical system. According to the concept of underground space rights, the second chapter underground space property rights and third chapter underground space using rights elaborate theories question about the property rights and the using rights detailed. In order to consummate our countries related legislation work, the author then attempts to solve underground space rights of legislative practice problem and provide authors suggestion that is the content on fourth chapter underground space rights of legislation's consummation by the research results above theory question analysis conclusion after later. This article last part, the conclusion summarized the core viewpoint and some positive suggestions about underground space rights question.
