As an important natural resource and social wealth, the land is a main carrier ofhuman production and lives since ancient times. With the advancement of socialistmodernization, the three-dimensional development of the land is an inevitable social reality.Underground space exploitation has already become a major way to relive traffic, upgradecapacity and improve living environment. However, compared with vigorous developmentstatus, the setting of the underground space rights system falls behind. As a new real estateproperty rights, establish and improve the legal system of underground space rights isextremely urgent. Given the present conditions, this paper puts forward several opinions onthe legal system establishment of underground space exploitation by using many researchmethods such as induction and analogy.In addition to the introduction and conclusion, this paper can be divided into fourparts. In the first part, the writer elaborates the basic background knowledge of space rightssystem. By comparing various points of view, this part analyzes the legal nature of theunderground space rights deeply. In the second part, this paper points out the presentproblems in the urban underground space development on the basis of the present situationanalysis. The third part summarizes three legislative modes about space rights in severalmajor foreign countries and Taiwan Region. This part can provide reference for our futurespace rights legislation. As the focus of this paper, the writer discusses the specificmethods to improve our space rights legal system in the fourth part. In view of currentoutstanding problem in our underground space exploitation, the writer considers that weneed to make clear provisions about space rights ownership、planning management、conflict resolution、 registration and circulation legal system.
