The judge acting as a referee is the process of taking samples , estimating evidence and integrating evidence ,be also the process that judge restructuring cognition, to apply the law . As the point of view of Cognition psychology, it is a process of inputting information, machining information and outputting outcome. Multi -factors which include :the order of evidences,characteristics of evidences,personality characteristic and mood state of judge etc will affect the process of "restructuring facts" and affect the final verdict.This study starts with the relationship among evidences, taking the order of evidences and characteristics of evidences as the independent variables, adopting the methods of experimentation and case analyzing to study the factors how to affect the judge's verdict.The main conclusive results of this research are the following:Study 1 finds that: the order of evidences,types of cases,characteristics of evidences will affect the judge's verdict. 1. Under different evidence presentation order, the verdict of simple case has reached significantly difference level, but the verdict of complicated case has not reached significantly difference level; 2. Analyzing the characteristics of evidences find that the serial position effect exists in each experiment condition, and the Primacy effect is the main effect. The research of Miller and Campbell finds that the Primacy effect exists in the condition of delaying answering, but this research finds that the Primacy effect even exists in the condition of immediately answering. 3. The critical evidence will affect person's cognition and estimation ,affecting the final verdict.Study 2 tries to analyze the case of Xu'ting, taking the point of view of quality analysis to demonstrate the hypothesis. Finding that anchoring and adjusting heuristic will affect the process of judge's verdict and punishment. The characteristics of evidences will affect the judge's verdict, in despite of the judge has realized or not.
