Research Of Environmental Dispute Administrative Solving Mechanism In China

With development of industrialization,urbanization and economy,the environmental problems become increasingly serious,thus,environmental dispute increases day by day and will become a great social problem.In order to face this challenge,according to each actual situations and law culture,the various countries develop the mechanism of environmental dispute resolution positively.In our country,we should reform the environmental dispute administrative solving mechanism.The environmental dispute administrative solving mechanism means a system combined with many effective administrative way of settling environmental disputes,such as administrative mediation and administrative adjudication.The second part gives an introduction of the background of the development of the environmental dispute administrative solving mechanism,in order that we can have a better knowledge of its history.The third part construes this mechanism in a functional way,which has three important functions,including perfecting the other methods of settling environmental disputes,the promotion of environmental administration in our country,and the realization of the justice and order.The fourth part introduces and reviews the environmental dispute administrative solving mechanism in Japan,Korea, Taiwan and the USA.Then follows my idea of constructing environmental dispute administrative solving mechanism in China.The fifth part analyzes the problems of environmental dispute administrative solving mechanism in current China from legislation,body setup,member station, methods of resolution and the legal effect.In response to the problems given in the fifth part,the sixth part gives the improvement advice respectively according to the advanced practical experience in other countries on the basis of our country's actuality.
