Research On Litigation Qualification Of Owner's Committee

As a new organization which came into being from the Real Estate reformation, the owner's committee plays an important role in Property Management. However, the initial step of property management in our country is too late, correlative lawmaking of which and the operational system of the owner's committee are still distempered. Therefore, contradiction and dissension of property management take place frequently, and so litigation is hard to be avoided. In the case of property management, there exists tremendous controversy in the issue on the parties' qualification of owner's committee, and the modus operandi of practice departments is also refusal to agree, which impairing the consistency and dignity of law. But the property Law which passed recently has no specific legislation cannot settle dissension felicitously. The practice of property management proves that whether the quality and status of owner's committee and its litigation qualification are explicit or not, which come down to critical benefit all of the owners.This thesis could be divided into four parts: Part one, expatiate on the conception and characters of owner's committee and several concepts which tie up with owners' committee mainly for further discussion on the following text. Part two, analyze the limitation and problems of owner's committee system and the legislation mode which could be used for reference by investigating the domestic and overseas lawmaking. Part three, in the basis on investigating above, analyze and determine the property of the owner's committee for further discussion on the property qualification of owner's committee .Part four, research on the property qualification of owner's committee, and bring forward some advice which could be used for reference for legislation.The judicial review of litigation qualification is the principal step of hearing the cases concerned the owner committee, and immediately relate to whether the parties' litigation right could come into being and the orders of their legal status. Therefore, it is unquestionable to have important academic and practice value for discussing on the property qualification of owner's committee.
