A Study On The Issues Of Macro-control Procedural Law

As a procedure legal system, Macro-control Procedural Law can ensure macro-control with procedural system and help the state's macro-control power run legally and smoothly. On the other hand, Macro-control Procedural Law can protect antipodes' rights and interests and provide relief channels.This text will study some issues of Macro-control Procedural Law from the view of theory and institution. The text contains four issues:Chapter one is about overview of Macro-control Procedural Law, which analyses Macro-control Procedural Law' meaning, character and the relationship with other procedural laws. Otherwise, chapter one analyses Macro-control Procedural Law from the economics, management and law theoretical perspective.Chapter two analyses and reflects the research and practice of Macro-control Procedural Law in China and Germany.Chapter three brings forward the idea of Macro-control Procedural Law, and makes a general discuss, which includes the idea's necessity and its value for Macro-control Procedural Law.Chapter four is the exploration for our country's Macro-control Procedural Law, which constructs the principles and specific systems of Macro-control Procedural Law.The innovation of this paper shows blew:Fist, it analyses the value and significance of Macro-control Procedural Law deeply from the view of economic theory, management theory and legal theory.Second, it discusses and puts forward the idea of Macro-control Procedural Law--procedure rational, moreover, it analyses procedure rational's value for Macro-control Procedural Law.Third, in accordance with the aforementioned theoretical analysis and our country's macro-control actuality, it conceives the Macro-control Procedural Law's content: the principles should be control efficiency and multi-harmony; the specific systems should be decision-making procedure, implementation procedure and relief procedure.
