After three decades of reform and opening-up, more and more rural regions have achieved nearby&in-situation urbanization by constructing small towns to expand the number of towns and improve the living condition of the farmers, which can not only promote the urbanizing level, transform the situation of production and living in the countryside and accelerate the development of the secondary and tertiary industry but also achieve the goal of common prosperity in urban and rural areas.Rural urbanization, that is the nearby&in-situation urbanization and the urbanization of the township in the administrative division, is a part of the development of urbanization in china, which can influence the transfer of the labor force, expansion of domestic demand and the improvement of public service facilities in the countryside. The large scale of urbanization in the countryside and the wide influence is unprecedented and can’t refer to any direct experience. Therefore, we need to work out a new model of urbanization with Chinese-characteristic. Different from the market-oriented model of urbanization in Europe and America, the urbanization in China is led by the government. Therefore, it is essential for the government to take an overall goal to update the system of macro-control and promote the scientific development of rural urbanization by effective intervene. The enforcement of governmental macro-control can bring about positive effects for our lives. Firstly, it is beneficial to transfer the rural labor redundance from rural areas to cities. Secondly, it is good for adjustment for industrial structure and relieving the considerable work pressure in the city. Thirdly, it can also improve the efficiency of resource and rural basic infrastructure.At present, we have lots of relevant information about the research of system of urbanization in our country. The research angle is mostly from economy and politics, but less and scattered from the law. In this paper, under the vision of the economic law, the author analyzes the important role of the rural urbanization in improving people’s livelihood and promoting the economic growth in China based on social standard principle and economic benefit principle. Further integration of the basic principle of economic law, rural urbanization improves people’s livelihood by improving the living quality of disadvantaged farmers, which embodies the social standard principle. Rural urbanization promotes the economic growth by optimizing the industrial structure and expanding domestic demand, which embodies the economic benefit principle.In recent years, with strong development momentum, rural urbanization has become the important area of governmental macro-control. But some deep and systematic problems have not been solved properly yet, such as the unreasonable urban and rural planning, the blocked land circulation, the unreasonable industrial structure, the unbalanced public services, the non-standard rural finance, the unharmonious urban and rural development, and so on. These problems are mainly caused by unreasonable macro-control. In the process of rural urbanization, considering the local interests, the government, as the main body of macro-control, blindly and excessively intervenes in the construction of small towns. The control procedure is arbitrary. Meanwhile, as the receptor of control, farmers are often in a weak position because of the weak legal consciousness. They can’t form effective game or effectively supervise and regulate the behavior of the governmental macro-control.The development of rural urbanization needs the government’s effective control, but the control must be moderate. In the process of rural urbanization, the government should further improve the system of macro-control, and use a combination of control methods, such as planning scientifically and reasonably, improving public services, improving the land circulation, improving the rural finance, improving the industrial structure, and coordinating urban and rural development. Moreover, we must strengthen the process control of the governmental regulation behavior. Through the reasonable design of announcement, notice, the hearing, and the judicial relief program, we can strengthen the standardization of the programs involved in the process of rural urbanization, and involve the farmers in the program and restrain the government from excessively intervening in urbanization. In addition, in the process of rural education, legal publicity, the government law enforcement, and legal services, we must improve the farmers’ legal consciousness, and guide farmers to know the laws, abide by the laws and use the laws to safeguard their legitimate rights and interests, and indirectly promote the improvement of the national macro-control.
