The Status Quo, Development And Improvement Of The Real Estate Registration System

The real estate registration system is vital for real estate deal. With a perfect registration system, the right of real estate can be established and transformed in order. The real estate registration system in our country had been improved in these years, but it lags far behind the flourishing estate market. Meanwhile, the system has many defects. Although the Property Law, the Measures for Land Registration and the Measures for Building Registration decreed in our country has improved the real estate registration system, it still need interrelated system .In this article, the author puts forward a series of ideas in order to complete the real estate registration system. At the same time, the author expects the provisions of the registration of real estate can be effectively implemented through the studies.In addition to the foreword and the conclusion, this article is divided into three chapters.Chapter one describes the basic theory of real estate registration system. It first defines the basic concepts, such as the definition of real estate, the definition and nature of real estate registration. Second, it discusses the core theory of real estate registration system, which is the publicity principle of real right alteration. Finally, it discusses the choice of the mode of real estate right alteration, which is the cornerstone of real estate registration system.Chapter two is about the history and current situation of China's real estate registration system. First it briefly introduces the history of China's real estate registration system. Next, it analyzes the deficiencies of our country real estate registration system existed before the Property Law was promulgated. Finally it introduces that our country real estate registration system had been developed after the Property Law was promulgated.The third chapter is the concern of this article. It points out that although our country real estate registration system had been developed after the Property Law was promulgated, but it still needs to be consummated. So as to make the Property Law provisions effectively implemented and enforced, we must establish a complete registration system. Currently, for consummating our country's real estate registration system, we must consummate the rationale of our country real estate registration system , establish unified real estate registration rule, perfect the potency of real estate registration, consummate reservation system and define the legal effect on objection registration and so on .
