The Consumer Protection In The Antitrust Law Perspective

What if the antitrust law has the ability to provide consumer protection? Is there any difference on the issues about protecting the consumer interest between Antitrust Law and Consumer Protection Law? The author of this article tries to answer those questions.On the basis of the study on the relevant national legislation,the author confirms that the antitrust law is able to provide consumer protection.Such protection relies on the declaration of the legislative intent,but the specific system of responsibilities is more important.This article consists of four parts,except the introduction and the conclusion.Part One:it discusses the association between the antitrust law and protecting the consumer's interest.On the basis of analysis of the damage of the consumer interest,this chapter determines the legal basis of the protecting the consumer interest in the Antitrust Law.After comparing the differences between the Antirust Law and the Consumer Protecting Law on the issues about protecting the consumer interest,this chapter argues the specificity of the consumer status in the antitrust law.Part Two:its main purpose is to analysis the consumer status in the legislation intent of the antitrust law.Through the study of different case, affirmed the importance of the goal of consumer protection.It analyses the reasons that the consumer interest works as the goal in the law,and finds out that protecting the consumer interest would not be the ultimate or the core goal of the antitrust law,it is only one goal the law pursues.Part Three:that analysis of consumer protection in private enforcement of antitrust law is in this chapter.Firstly,it affirmed the positive significance of private enforcement,then discusses the identity of consumer in private enforcement,and affirmed that different liability leads to different incentives.,which as a comparison.Part Four:it is mainly on the relevant provisions of our Antitrust Law. Pointed out that legislative goal of consumer protection purses,it is necessary to perfect the relevant systems.
