Although consumer is not the party concerned in market competition, from the antitrust legislation in other countries, the party is one of the objects that antitrust law needs to protect. This is because monopoly impairs not only legal operators'rights and interests, but also consumer's rights and interests. Usually consumers bear more loss than legal operators, and the scope of the loss of consumers includes property damage and personal injury. China's anti-monopoly law determines that consumer is one of the objects it needs to protect, and protect- consumer is recognizing as the goal of China's anti-monopoly law. But China's anti-monopoly law still has defects in protect- consumer, it is unable to provide enough protection for consumer. So, the writer wanted to research on how to improve China's anti-monopoly law system, adopting the method of history-analysis, compare-analysis and economy-analysis. This paper analyses characteristics of consumer's rights in anti-monopoly law first, then it analyses the status about China's anti-monopoly legislation, and studies on the anti-monopoly law in other countries. And the writer tried to put forward some legislative proposals for the anti-monopoly legislation of China.This article first studies the characters of consumer's rights in anti-monopoly law. After comparing the differences between the anti-monopoly law and the consumer protecting law on the issues about protecting the consumer interest, this chapter analyses the function of consumer in anti-monopoly law. Chapter two of this paper studies the reason for that why the anti-monopoly law should protect consumer. This chapter analyses the economical, jurisprudential and practical reasons for it. Chapter three of this paper studies the current situation of China's existing anti-monopoly legislation. This chapter points out the advantages and disadvantages of anti-monopoly law. Chapter four of this paper studies the anti-monopoly law of other countries. This chapter analyses that how the anti-monopoly legislation protects consumer in the United States and Germany. Last party of this paper brings forward some anti-monopoly legislative proposals conforming to the situation of China.
