Research About Scientificalization Of Legislation Of Work-related Injury Certification

Worker-related injury certification, which is the procedural starting point and the important part of work-related injury insurance system, is the process that certification department upon the certification application put forward by applicators makes the decision about whether workers'injury is able to fulfill the composing element of word-related injury according to relevant acts and regulations. The balance between efficiency and justice, supplementation to the system of traditional civil damages, and the unification of individual interest and social stability are the main subjects of legislation of work-related injury insurance. However, in reality, the external effect of work-related injury insurance is incoherent with main subjects above mentioned. The development of legislation of work-related injury insurance shall be dependant on the improvement of system of work-related injury certification owing to its fundamental role. A systematic analysis on the existing questions of certification of work-related injury has been given in this article, and its details are as follow:The first chapter is mainly showing the existing condition of running of the certification of work-related injury.The second chapter mainly introduces the definitions, features and composing element of work-related injury and work-related injury certification, discusses the characteristics and value orientation of work-related injury insurance.The third chapter starts with the definitions of procedure and legal procedure, briefly introduces the theory of procedural value and evaluates the existing question of work-related injury certification using the standard of procedural rationality.The fourth chapter makes the comparison between Wisconsin Worker's Compensation Law and Worker's Disability Compensation Act of 1963 and Administrative Rules as Amended to learn their experience.The fifth chapter puts forward some proposals about improvement of legislation of work-related injury certification accompanied with analyzing the practical situation in China.
