The Consideration On The Law-theory Of Anti-Family Violence Under The Harmonious Society Background

Families are the basic cells of the society, and family stability is the basis of social stability. Family violence is a negative factor against family harmony and the harmonious and stable development of the society and a crime against the rights of other family members. As a social existence, family violence is caused by complicated reasons. However, current laws and codes are lack of applicability, which leads to lots of difficulties in relieving family violence causalities. Therefore, an in-depth study of the law issues of family violence from theoretical and empirical perspectives is of great significance for protecting the rights of the causalities of family violence and promoting the equality and stability of the society.Apart from the introduction and conclusion parts, this dissertation includes four parts.The first part describes the concept of family violence in the discussion and restricts the research range in this article. Meanwhile, it illustrates the characters of the law in family violence based on what we have discussed above. We have made a comparison between the concept of introduction of family violence and contents in Chinese correlative areas, we make a conclusion that the family violence should consist of physical violence, psychical violence, sex violence and financial violence in the family members.The second part mainly analyzes the significance of anti-family violence under the harmonious society background. We make a discussion on how to construct a harmonious society in construction of democratic legal system and the maintenance of the social stability.The third part mainly illustrates the causes of formation theories which are comprehensively occurred in family, as well as the system of anti-family violence. After the introduction about the reasons in incurring family violence around the world, we also analyze the reasons of Chinese family violence in social variance, abnormal personality and law- regulation. We make an emphasis on moral self-obligation and the deficiency of law-regulation about the family violence and the mechanism of social remedy.The fourth part illustrates how to compose the Chinese anti-family violence system which is consist of the following 4 aspects: Firstly, we should strengthen the education of the family moral legal system. Secondly, we should enhance the juristic criterion system in preventing family violence. Thirdly, we should build the line of defence about basic anti-family violence system. Fourthly, we should optimize the resources and construct the social-net about the anti-family violence around all the society.
