The essay take the institution of restriction upon employee from ex-employer in order to protect trade secrets as the point of departure, to economic investigation into the system of intellectual property law start with evolution economy, guided by the idea of liberty in occupational choice, watch on the erosion of the right of labor because of the institution of restriction upon employee from ex-employer, watch on the injured liberty in occupational choice because of the surplus value from intellectual property is monopolized by the enterprise owner, watch on that in the time of knowledge-economy the west developed countries limit developing countries to transfer to higher industrial structure through the International Intellectual Property Law.The author's view is presented through the four chapters of the text:The first chapter mentioned the meaning of the liberty in occupational choice, and introduced the meaning and type of restriction upon employee from ex-employer.The second chapter viewed the institution of restriction upon employee from ex-employer with the Comparative Law.The third chapter investigated our country's institution of restriction upon employee from ex-employer and its effects.The fourth chapter mentioned the idea how to make better of he institution of restriction upon employee from ex-employer.As concluded, trade secrets law primarily used the measure of competition law, thus show out the economic law value of the Intellectual Property Law. We must protect the Liberty in Occupational Choice in the time of Economy based on Knowledge.
