On The Guardianship System Of Minors In Internet Virtual World

Compared with the traditional realistic society, the network virtual society is a bran-new social system of virtualization and symbols with experience, interactivity, collaboration, virtualization and so on. These characters carry out a new challenge of the minors'guardianship. It should be said that, China's current law has involved a lot of content of protection for the minors, but guardianship and protection are two different concepts. In the network virtual social, the guardianship's main body, means and contents have taken place in a lot of changes, and the traditional minors'guardianship and the correlative laws and regulations of the minors'protection have been unable to adapt to the demands of the reality. It is not a kind of traditional protection to strengthen the minors'guardianship in the network virtual society, and we must carry out more effective, more specific and more realistic acts for the minors'protection from wider areas with more stringent requirements. Therefore, there is inevitability in construction and improvement of the minors'guardianship system in the network virtual society.At present, the security situation of China's minors in the network virtual society is not optimistic, mainly as follows: (a) addicted to the network; (b) the erosion of network drug; (c) cyber crime. Facing this serious security issues, China's current minors'guardianship system in the network virtual society can not be an effective minors'protection system in the network virtual society in protecting their legitimate rights and interests and protecting their healthy growth. The main problems are: (a) lack of a guardian; (b) imperfect guardianship laws; (c) the absent responsibility of the guardianship. Facing this situation, it is the urgent affairs for the construction and improvement of the minors'guardianship system in the network virtual society.Based on learning from the advanced experience of foreign countries and integrating China's specific national conditions, this paper carries out to construct and improve the minors'guardianship system in the network virtual society from the views of the state guardianship, society guardianship, family guardianship and school guardianship. In the view of state guardianship, the state must improve a sound network law system through the legislature, and strengthen the judicial building. In the view of social guardianship, firstly, it should strengthen monitoring the network information and optimize the network environment. Secondly, to strengthen the controlling eroticism information; thirdly, should establish and improve the system of the level of access for game software; fourthly, we should strengthen the management of Internet cafes and Construct "safe internet cafes". In the view of the family guardianship, firstly, parents should improve their own network capacity and quality; secondly, parents should monitor young people to access to the network with mercy and perfection; thirdly is to take some effective methods to guide young people to access the network. In the views of the school guardianship, the schools should strengthen the education of minors'network accomplishment, thus students can understand and use the network correctly.
