Under the circumstance that the legal environment is not very perfect, it has great theoretical and practical significance to analyze the current situation of windmill, the advantages and disadvantages of windmill, the nature of windmill, whether windmill is legal or trading, the compensation of damage by windmill, and to perfect the legal problems of windmill to let it develop healthily.This paper includes five sections:1)Overview the development of windmill at home and abroad, the positive significance and problems need to solute at home.2) Legality of windmill. From the angle of contract and its freedom to analyze the nature of windmill, the content of contract and the significance and effectiveness is shown.And through analysis of the differences between windmill and trading or fight cars (including illegal car and taxi for fight), the conclusion can be drawn that there isn't trading nature in windmill, and then it is legal.3) Compensation of damage from accident of windmill. The nature of responsibility, type of compensation, principle of Liability and Shared responsibility is researched separately. 4) Perfection of windmill. It can be done in four aspects. The first is establishment, soundness and publicity of legal. Secondly management system is created, and Management mechanism is innovated. The third is to perfect the contract assignment. The final aspect is Dispute solution including some suggestions on reconciliation, litigation and compensation.
