There are no laws currently in force that stipulate the legitimacy of euthanasia in China, however, euthanasia has been practiced in more and more places stealthily. The absence of the relevant laws has excused the judiciary authorities'form taking any judicial actions against this practice. The author elaborated on the necessity of legislation on euthanasia from the prospective of the regulating function of laws, and proposed the frame work of legislation with the analysis on the difficulties in law making. The law making process is difficult but behaviors must be standardized in compliance with laws. As the euthanasia is late to the right of life, it shall not be legitimate until the legislature approve. The criminal law theory concerning the legitimization of euthanasia has the basis of exemption from punishment, ground of legal pleading and theory of exclusion from endangering society. From the viewpoint of the situation of China, legitimization of euthanasia has been feasible.
