The Vacation System In China

The vacation right is a basic human right. The vacation system is the floorboard of all the relative systems to safeguard and support the labor's vacation right and realize all the rights. The vacation system, in a broad sense, should be involved with every aspect of the citizen vacation. The content of the vacation system should include cyc-vacation system,the legal holiday vacation system,permanent vacation system,vacation safeguard system,vacation industry policy. This article analyzes the history of Chinese vacation system and the characteristics of the vacation system in several countries, and on the foundation of Chinese vacation system, puts forward some perfection regulations. The article includes 3 parts.The first part firstly introduces the concept of the vacation right and vacation system. The second introduces the content of the vacation system, which includes cyc-vacation system,legal holiday vacation system,yearly vacation system,permanent vacation system,vacation safeguard system,vacation industry policy. The third part introduces the functions, which include labor reconstruction function,socialization function,consumption function,development function. The last part introduces the meaning of the vacation, and the vacation helps to develop the personality freedom and the full satisfaction of the individual need.The second part introduces ancient Chinese vacation system and the vacation systems in some typical countries. The ancient Chinese vacation system has come through more than 2000 year development, and gradually become mature. The legal vacation system started from Qin-Han period, reached to the peak during Song dynasty. The cyc-vacation system started from Qin-Han period and during Sui-Tang period the Xun-xiu system has been formed and lasts for more than 1000 years. Each dynasty according to the social & economic conditions and canonicals of the time, make the detailed regulations, and also make the explicit explanation on paid vacation. At the same time, the retirement system is also an important content of ancient vacation system which basically accords with the present social & economic development, and causes the deep affection. Many of the modern Chinese vacation system originate from ancient vacation system, such as Spring Festival,Tomb-sweeping Day,dragon boat festival,mid-autumn festival, which all originated from the ancient time. Some holidays, though they are not the legal holiday, are still loved by the people, such as festival of lanterns,Chinese valentine's day,The Double Ninth Festival etc.The world's developed countries or regions have a small number of statutory holidays, the law does not, and these countries or regions, China's statutory holiday days in the middle class. Developed countries or regions of the system of paid leave after years of development have been better to become a major vacation, and very flexible, to obtain the national consensus. The Government made great efforts to promote the concept of people leave at the same time a high level of economic development and improve the supporting facilities to ensure that people can enjoy universal vacation. States leave the stage: the most leading European countries, followed by the United States and other developed countries, Asian countries is relatively backward.1. Length of time the existing holidays will not be any major growth. China is now the total length of time for the holidays 115 days, and paid annual leave each year, workers will be at least 120 days of rest, as a whole accounts for about one-third of the total number of days, so in the future direction should be to leave Time and science sections of the structure adjustment.2. Paid annual vacation leave is the implementation of the system the key to improving the system. On the vacation of the characteristics of the system, we can conclude that China has implemented a system of paid annual leave of reality. China has paid annual leave with the implementation of the material conditions of the economy. Secondly, has become more mature public demand for travel and tourism market more complete.The third part is mainly on the legal regulations of China's current vacation system, which includes the circulation vacation system, statutory holiday vacation system, the system of paid annual vacation, permanent vacation system, in particular, special vacation and vacation security system.And the third part mainly introduced the characteristics and its perfection of the current vacation system. 30 years since 1987, our government, by laws, rules, regulations, legal interpretation, notice, and so has approved and raised the vacation affinity and the total length of "Golden Week" for more than 50 times. as a transition to the final realization of paid leave for the addition of the main traditional holiday vacation system, our long national holiday when a substantial increase, more vacation flexibility and humanity, leave the system quickly with the world And even better. Leave the public attitude has been a fundamental shift from a single body independent of the rest into individual requirements.The perfection of the current vacation system is focused on improving the system by strengthening legislation, implementation, supervision, and other measures to improve the system of paid annual leave, paid annual vacation system is to protect workers enjoy the right to rest one of the important ways, the implementation of paid annual vacation system, not only for workers with full respect for the right to rest, it is an important indicator of social progress. Paid annual vacation system can provide a more flexible vacation, to give workers more options to stimulate consumption, activation of economic, social, business, individuals are very good. This was followed by changes in the timing of holidays, leave the bypass to increase the number of long holidays, to the masses of the people can provide more opportunities for travel. Once again vigorously carry forward the traditional festival, a traditional festival to promote the fine cultural traditions, building a harmonious socialist society in accordance with the requirements so that the nation has become a traditional festival to meet the people's spiritual and cultural needs of the important channels. At the same time vigorously to protect the vacation right of the vulnerable group, relying on the government to urge the implementation of the system off. Personnel and the State Department of Labor and Social Security to leave on a regular basis on the implementation of the system to conduct random checks on workers in violation of the right to leave the violations investigated and dealt with severely. States should enact laws and regulations to strengthen supervision over the implementation of increased enforcement efforts to protect the right to leave the implementation. Trade unions should play in accordance with the law to safeguard workers the right to leave. For refusing to comply with the provisions of the right to leave the country, workers have the right to appeal to the authorities, government departments have the responsibility to supervise the implementation of unit labor leave the system.
